Land Conservation Committee acts on Roth Feeder Pigs II CAFO permit

CRAWFORD COUNTY - Crawford County Land Conservation Committee (LCC) took action on the Livestock Facility Siting Permit for the Roth Feeder Pigs II hog CAFO at their December 9 meeting. All members of the committee except Kate Krachey were present for the meeting.

The Roth Feeder Pigs II permit was issued by the county on August 9, 2022. At the committee’s November 2025 meeting, County Conservation Director Dave Troester had shared a letter from Wisconsin DNR regarding the Wisconsin Pollution Discharge Elimination System (WPDES) and Livestock Facility Siting Permit (LFSP) issued by them for Roth Feeder Pigs II (RFPII).

That letter notified the county that “due to lack of approved Plans and Specifications, issues with the Nutrient Management Plan (NMP), and incomplete landowner information, Roth Feeder Pigs II is prohibited from populating any facilities associated with WPDES permit number 0066788-01-0.”

At the November meeting, the committee discussed whether to take action on the LFSP for RFPII issued by the county. They voted to table the decision to their December meeting so that RFPII owner AV Roth could be notified of the committee’s intention to take action, and have the chance to attend in person.

“Just after the November LCC meeting, I met with the DNR, who was there to do Roth Feeder Pigs I’s five-year review,” Troester told the committee. “I told him (Roth)what was going on, and he’d seen my invites to the November meeting, had gotten the agenda just the day before, and couldn't make it.”

Troester said he’d also e-mailed him the agenda for the December meeting. Nevertheless, AV Roth was not in attendance at the LCC’s December meeting either.

“It kind of just goes back to that discussion that we had year-and-a-half ago about how our ordinance says that after two years, LCC may revoke the permit if no progress has been made on constructing, populating and operating the facility,” Troester explained. “At that time, the committee decided that as long as he was progressing and looking to move forward, the matter would be tabled, with the understanding that AV would keep us up to date.”

Troester said that at this point, neither his department nor the committee really have any information about Roth’s intentions regarding the RFPII facility.

 “When I was at his farm recently, he didn't really make any comments about it, but said he would probably attend this meeting,” Troester shared. “I don't know what his plan is any longer.”

Committee member Mary Kuhn said that in 2022, the committee decided that as long as Roth had approval from DNR for the RFPII facility, the committee would approve the county LSFP permit.

“Since it is no longer the case that he has approval to proceed from DNR, my opinion is that we should revoke the permit, and they can start the process all over again,” Kuhn said.

Troester read to the committee the language in the county’s LFSP Ordinance granting them authority to revoke the permit:

“A license remains in effect, regardless of the amount of time that elapses before the livestock operator exercises the authority granted under the license, and regardless of whether the livestock operator exercises the full authority granted by the approval. However, the County may treat a license as lapsed and withdraw the license if the license holder fails to do all of the following within two years after issuance of license - begin populating the new or expanded facility and begin construction of all new or expanded livestock housing or waste storage structures proposed in the application.”

The committee voted unanimously to withdraw the Livestock Facility Siting Permit issued to Roth Feeder Pigs II.

Troester said he would send Roth a formal written statement about the committee’s decision, along with the minutes of the committee’s December 2025 meeting.
