A Platteville man arrested or cited in Platteville eight times in the past 17 months was sentenced to nine months in jail on a lewd conduct charge.
Ashley J. Toney, 25, was found guilty of a charge of lewd and lascivious behavior — exposure after a one-day jury trial Aug. 23.
Grant County Circuit Judge Robert VanDeHey sentenced Toney to nine months in jail — the maximum sentence for a Class A misdemeanor charge — and assessed $443 in court costs.
VanDeHey allowed Toney work release privileges and to serve his sentence in Dane County, where he was charged with resisting or obstructing an officer and misdemeanor bail jumping Aug. 6, according to court records.
Toney stood mute to the Dane County charges Aug. 15, and a plea of not guilty was entered on his behalf, according to court records. A pretrial conference is scheduled in Dane Count Sept. 18.
Toney was charged for an incident May 7, according to court records. He pleaded not guilty June 5.
Toney filed a notice of intent to appeal his conviction Wednesday, according to court records.
Toney was first charged with lewd and lascivious behavior — exposure for an alleged incident at the former Platteville Public Library in April 2016. He was acquitted of that charge after a jury trial June 1, 2016.
Toney was then charged with lewd and lascivious behavior — exposure for an alleged incident May 3, 2016. That charge was dismissed by a Grant County District Attorney motion Feb. 2, according to court records.
Toney then was acquitted of another lewd and lascivious behavior — exposure charge as a repeater, but sentenced to 90 days in jail after he was convicted of resisting or obstructing an officer as a repeater after another one-day jury trial Aug. 11, 2016. Toney was arrested after an incident on the Rountree Branch Trail June 6, 2016, according to court records.
Toney appealed his conviction in August 2016, but his appeal was denied by the state Court of Appeals in March, according to court records.
Toney was then charged with disorderly conduct for an incident May 11. He was acquitted of that charge after a one-day jury trial June 27, according to court records.
Toney then received two trespassing citations June 28 — one for trespassing on UW System property and another citation issued by Platteville police. He pleaded no contest to each charge and was fined $200.50 for each charge, according to court records.
Toney then was cited by city police for trespassing July 2. He pleaded not guilty to the charge July 31. A court trial is scheduled for Sept. 22.
Toney is on the State of Indiana Sex and Violent Offender Registry through 2023, according to the Wisconsin Department of Corrections.
According to the Northwest Indiana Times, Toney served two years of a four-year prison sentence and was required to register as a sex offender after a jury convicted him of two counts of sexual battery, one count of criminal confinement, and misdemeanor charges of public indecency and criminal recklessness for incidents that took place on a Portage Township, Ind., school bus. He was accused of repeatedly fondling two female students between November 2008 and February 2009, placing his legs across the aisle of a school bus to prevent a student from leaving, repeatedly exposing himself and lighting a piece of paper on a bus on fire.
